Accused child killer Donald Smith in protective custody

JACKSONVILLE, Fl -- The man accused of kidnapping and murdering 8-year-old Cherish Perrywinkle is being kept in protective custody inside the Duval County jail.

This means he is being kept out of the jail's general population.

Action News asked JSO if Smith was on suicide watch but officers would not give us that information.

Action News also asked why Smith was dressed differently than other Jacksonville inmates when he made his first court appearance on Sunday.

In video from Sunday, Smith wore a red jumpsuit. The Jacksonville Sheriff's Office says 'high profile' inmates are dressed in red so they are quick and easy to spot in court and inside the jail.

Action News also asked whether Smith had any visitors.  So far, he has not, according to JSO.

Smith pleaded not guilty to charges including murder and kidnapping at a first appearance on Sunday. He was denied bond. His next appearance is set for July.

JSO says Perrywinkle was kidnapped late Friday night from the Northside Walmart off of Lem Turner Road. He was arrested Saturday, June 22, along I-95 just north of the I-10 split after an officer spotted his van.

Police say a woman first spotted the white van driving suspiciously near the Highlands Baptist Church on Broward Road. Within an hour of Smith's arrest, officers found the little girl's body in some woods behind the church.

Officers have not released how she died or what they believe Smith was doing from the point of the abduction until his arrest.
