Mayport Middle student says he was choked by bully

ATLANTIC BEACH, Fla. -- A local boy is telling Action News how he caught students with drugs inside a middle school bathroom and received death threats because of it.

"He had a giant big bag of marijuana and I didn't feel like I should be in there so I went in line outside the bathroom," said Joe. 

Joe and his parents said they told Mayport Middle School about the incident, but say when word got out the bullying started.

"Telling me they were going to stab me, cut me," he said. The 12 year old said one of the students attacked him on the school bus in December. "He just grabbed me by the neck and pushed me up against the glass of the window, and strangled me and I couldn't breathe, I couldn't see, and could barely move."

Action News obtained the police report that the family filed and the pictures they took right after the incident. Joe's father said the boys even showed up at their home with a gun. That’s when the Robertsons pulled the boy out of school and asked for a transfer. A letter from the school’s principal said the report of bullying was not substantiated.

"Him being threatened with knives, him being physically harmed wasn't a big enough case for bullying for him to be transferred to a different school," said Joe's mother, Leslie Robertson.  

We reached out to Superintendent Dr. Nikolai Vitti. While he wouldn’t speak specifically about this case, he did say requests like the Robertson’s had been honored in the past.

"We have granted special transfers based on safety related issues, and we will always continue to do that to make sure that the parent and the student feels comfortable in a learning environment," said Vitti. 

The school board would not say if that’s what they’re planning to do in this case. The family said that is their only option.
